U.S. trading activities in Europe: the impact of new EU transaction reporting and position limits rules

Two key aspects of MiFID II and MiFIR – transaction reporting and the new position limits regime – are likely to have a wide-ranging impact on any person transacting in the European derivatives markets, including traders located in the United States. MiFIR significantly broadens the transaction reporting requirements to cover a wider range of products and reportable transactions. MiFID II establishes a new, European-wide position limits regime that, while similar in certain respects to the CFTC position limits rules, also departs considerably from the CFTC approach in several areas.
