Cross-border enforcement defense issues

For our June webinar, a panel of Allen & Overy partners from the U.S., London and Hong Kong will discuss current topics relating to cross-border enforcement defense issues including, among other things:

  • Non-U.S. entities responding to U.S. inquiries --  When should the recipient of a request require the U.S. regulator to go through their counterpart in the local jurisdiction (e.g., through the IOSCO MOU)?  What are the pros and cons?  Are there situations where a compelled response is preferable, for example because of local data privacy concerns.  Does asserting your rights put “cooperation credit” in jeopardy?
  • Criminal liability --   When is extradition possible?  For non-U.S. practitioners, what are the actual limits of U.S. jurisdiction outside of the U.S. (and do U.S. regulators generally respect those limits, or do they push past them)?
