Recent regulatory developments have shown that indirect clearing for ETD (and OTC) presents a number of legal and operational complexities that are not easy to resolve. Some of these complexities have been recognised by regulators which resulted in the delay of the publication of the MiFIR RTS on indirect clearing arrangements for ETD. This session will focus on the ESMA consultation paper on this topic [expected to be published soon] and, to the extent that there is more clarity around indirect clearing requirements for ETD. We shall discuss next steps in terms of implementing them in practice from a legal, business and operational perspective.
